Arrest and loss of position: what awaits Fedorishchev after the dismissal of an “eccentric” official

The governor of the Samara region, Vyacheslav Fedorishchev, fired the head of the Kinelsky district, Yury Zhidkov, with profanity. Baza telegram channel talk with experts and find out what awaits the head of the region and whether such a dismissal has legal force or not.

The incident occurred during the governor's business trip to the area. Here he discovered a stone on the school grounds with a sign stating that a memorial would be erected in this place in memory of the participants in the Great Patriotic War. When the governor asked Zhidkov what it was, he replied that it was “a stone.” Then Fedorishchev told him: “The bastard is fired” and emotionally patted him on the shoulder.

According to lawyer Mikhail Timoshatov, it is impossible to terminate the contract with such a statement, and it is not easy to fire the head of the district either – the law stipulates that certain actions must be taken for this. In addition, some experts believe that officials can apply to the prosecutor's office to request protection of honor and dignity as well as challenge the legality of the dismissal.

However, there are nuances. For example, Beslan Utegushev, managing partner of the YUKAM law firm, believes that Zhidkov would need an examination to prove insult. At the same time, lawyer Oscar Cherdzhiev is confident that Fedorishchev's actions can be considered an administrative violation according to Art. 20.1 of the Code of Administrative Offenses of the Russian Federation (petty hooliganism) – according to which the court can assign the governor 15 days of arrest.

Lawyer Alexander Zorin also has a similar opinion: he believes that Fedorishchev violated state language laws. Such action could lead to the governor himself being removed from office due to loss of confidence.
